Competent Authority & System
Official Authority: Spanish Patent and Trademark Office / Oficina Española de Patentes y Marcas (OEPM).
Official Language: Spanish (Castilian). Regional co-official languages (e.g., Catalan, Galician, Basque) may be used for initial filings at regional autonomous IP offices, but proceedings before OEPM are conducted in Spanish.
System: National IP system based on Trademark Law 17/2001 (Ley 17/2001 de Marcas, as amended by Royal Decree-Law 23/2018). As an EU Member State, protection in Spain can also be obtained via European Union Trademarks (EUTM) administered by the EUIPO.
International Treaties
Madrid System: Member of both the Madrid Agreement and the Madrid Protocol (since November 15, 1892 / December 1, 1995). Spain can be designated in international applications via WIPO.
Paris Convention: Member state; convention priority can be claimed within 6 months from the initial priority filing date.
Applicant & Representation Requirements
Entitlement: Both natural persons and legal entities (domestic or foreign) are eligible to apply.
Representation for Foreign Applicants: Non-resident applicants from outside the European Union (EU) or European Economic Area (EEA) must be represented by an authorized local Official Industrial Property Agent (Agente de la Propiedad Industrial - API) or a representative-at-law admitted to practice in Spain.
Power of Attorney (POA): Required when represented. A simple signed Power of Attorney is accepted; notarization or Legalization/Apostille is not required unless explicitly requested under exceptional doubts by OEPM.
Online Services & Database
E-Filing: E-filing is fully operational and incentivized via the official OEPM portal (Sede Electrónica), offering a statutory 15% discount on official fees compared to paper submissions.
Free Trademark Search Database: Public searches are accessible free of charge via the official OEPM CEO Search Database (Consulta de Expedientes OEPM / CLINMAR), as well as TMview, EUIPO eSearch plus, and the WIPO Global Brand Database.
Registrable Mark Types
Types: Word, figurative/logo, combined signs, 3D shapes/packaging, color marks (single or combinations), sound (audio files or score), motion, multimedia, pattern, and position marks capable of clear visual or digital representation in the register.
Foreign Characters & Translation: Applications featuring non-Latin scripts or non-Spanish words must include a transliteration into the Latin alphabet and a translation into Spanish.
Classification Framework
Nice Classification: Applies the active edition of the Nice Classification.
Multi-class Filings: Permitted under a single application.
Class Headings: Accepted, provided they conform to standard EU common practice (IP TRANSLATED principles) for clarity and precision.
Examination Process
Examination Scope:
Formal & Absolute Grounds: Examined ex officio by OEPM (distinctiveness, descriptiveness, genericness, public order, deceptive signs, bad faith).
Relative Grounds: OEPM does not refuse applications ex officio on relative grounds (prior conflicting trademarks). Examiners perform an ex officio automated search report and send informational notices to prior rights holders, who must actively enforce their rights through third-party opposition proceedings.
Office Action Deadlines: Standard response time for formal deficiency letters or provisional refusal notices on absolute grounds is 1 month from official publication/notification.
Publication & Opposition
Opposition Window: 2 months starting from the publication date of the application in the Official Industrial Property Bulletin (Boletín Oficial de la Propiedad Industrial - BOPI).
Standing: Owners of earlier registered Spanish trademarks, EUTMs, international registrations designating Spain, pending applications with earlier priority, well-known marks under Article 6bis of the Paris Convention, or trade names (Nombres Comerciales). Opponents may be requested by the applicant to provide proof of genuine commercial use if the prior mark has been registered for more than 5 years.

Additional Class Filing Fee (Online - 2nd Class & each subsequent): €82.84 per class.
Paper Submission Fee (1st Class): €150.45 (plus €97.48 per additional class).

Standard Renewal Fee (10 Years - Online 1st Class): €127.88.

Duration & Renewal
Validity Period: 10 years calculated from the filing date.
Renewal Duration: Renewable indefinitely for consecutive 10-year terms. Renewal applications can be filed within the final 6 months prior to expiration.
Grace Period: A 6-month grace period post-expiration is allowed for late renewal, subject to an official late payment surcharge (25% or 50% increase depending on payment month).
Use Requirements & Priority System
Priority System: First-to-file system. Priority documents can be submitted within 3 months from the filing date.
Non-Use Cancellation: A registered trademark becomes subject to revocation (caducidad) on non-use grounds if it has not been put to genuine commercial use in Spain for a continuous period of 5 years post-registration.
Declaration of Use: No periodic maintenance declarations or affidavits of use are required during routine 10-year renewals.
Post-Registration Transactions
Recordals: Rights assignments, licensing agreements, pledges, and changes of corporate details (name/address) must be officially registered in the Register at OEPM to be legally binding against third parties.
Legal Remedies & Enforcement
Cancellation & Invalidity: Direct administrative invalidity (nulidad) and non-use revocation (caducidad) claims are handled administratively by OEPM (following legal reforms aligning with EU Directive 2015/2436), as well as through specialized Commercial Courts (Juzgados de lo Mercantil).
Customs Enforcement: Brand owners can file applications for customs border surveillance with the Tax Agency (Agencia Tributaria - Customs) under EU Customs Regulation (EU) No 608/2013 to intercept counterfeit goods at the border.
Country-Specific Risks & Practical Insights
Informational Relative Notices vs. Refusal: OEPM conducts relative grounds searches and sends automated courtesy alerts to owners of earlier registered marks. However, OEPM does not refuse applications ex officio on relative grounds; prior mark holders must formally file an opposition within the 2-month publication window.
Administrative Nullity & Revocation Jurisdiction: Following recent statutory reforms, OEPM handles administrative invalidity and revocation actions directly, providing a faster and less expensive alternative to civil court litigation.
Protection of Trade Names (Nombres Comerciales): Spain maintains a distinct parallel national register for business trade names (Nombres Comerciales), which function similarly to trademarks and can be cited as prior rights in opposition proceedings.
