Official Authority: Monegasque Industrial Property Office / Office Monégasque des Titres de Propriété Industrielle (MCIPO).
Official Language: French.
System: National IP system. Monaco is not an EU Member State, meaning European Union Trademarks (EUTM) do not automatically extend to or cover Monaco.
International Treaties
Madrid System: Member of both the Madrid Agreement and the Madrid Protocol (since September 27, 1956). Monaco can be designated in international applications via WIPO.
Paris Convention: Member state; convention priority can be claimed within 6 months from the initial priority filing date.
Applicant & Representation Requirements
Entitlement: Both natural persons and legal entities (domestic or foreign) are eligible to apply.
Representation for Foreign Applicants: Non-resident applicants without a domicile or real commercial establishment in Monaco must be represented by an authorized local Monegasque representative/representative.
Power of Attorney (POA): Required when represented. A simple signed Power of Attorney is accepted; notarization or Legalization/Apostille is not required unless requested under specific doubts by MCIPO.
Online Services & Database
E-Filing: E-filing and digital form submissions are available via the official MCIPO portal.
Free Trademark Search Database: Public searches are accessible free of charge via the MCIPO Official Register, as well as TMview and the WIPO Global Brand Database.
Registrable Mark Types
Types: Words, logos, figurative marks, 3D shapes/packaging, color combinations, sounds, and other signs capable of clear graphical representation.
Foreign Characters & Translation: Applications with non-Latin characters or non-French words must include a transliteration into the Latin alphabet and a translation into French.
Classification Framework
Nice Classification: Applies the active edition of the Nice Classification.
Multi-class Filings: Permitted under a single application.
Base Class Inclusion: The basic national filing fee covers up to 3 classes.
Class Headings: Accepted, provided they conform to standard guidelines for clarity and precision.
Examination Process
Examination Scope:
Formal & Absolute Grounds: Examined ex officio by MCIPO (distinctiveness, descriptiveness, genericness, public policy, deceptive signs).
Relative Grounds: MCIPO does not examine or refuse applications ex officio based on prior conflicting trademarks. Protection against confusingly similar prior rights relies on post-registration judicial actions.
Office Action Deadlines: Response to formal deficiency notices or provisional refusals on absolute grounds is typically required within 1 to 2 months from official notification.
Publication & Opposition
Opposition System: No administrative opposition procedure exists. MCIPO does not maintain an administrative opposition window.
Enforcement of Prior Rights: Earlier rights holders must bring invalidity or infringement actions directly before the competent Monegasque courts (Tribunal de Première Instance).
Timeline & Expedited Examination
Average Timeframe: Approximately 2 to 4 months from filing to registration/issuance in smooth cases.
Expedited Examination: Fast-track examination procedures are not standardly offered as a commercial paid service, but standard digital processing is relatively fast.
Official Fees
Official statutory fees at MCIPO are assessed in Euros (EUR):
Base Application Fee (Covers up to 3 Classes): €130.
Additional Class Fee (From 4th Class onward): €40 per class.
Standard Renewal Fee (Covers up to 3 Classes): €190.
Renewal Additional Class Fee: €40 per class.
Grace Period Renewal Surcharge: Additional 50% of the renewal fee due.
Duration & Renewal
Validity Period: 10 years calculated from the filing date.
Renewal Duration: Renewable indefinitely for consecutive 10-year terms. Renewal requests can be filed within 6 months prior to expiration.
Grace Period: A 6-month grace period post-expiration is allowed for late renewal, subject to a 50% late surcharge.
Use Requirements & Priority System
Priority System: First-to-file system.
Non-Use Cancellation: A registered trademark becomes subject to revocation on non-use grounds if it is not put to genuine commercial use in Monaco for a continuous period of 5 years post-registration.
Declaration of Use: No periodic maintenance declarations or affidavits of use are required during routine renewals.
Post-Registration Transactions
Recordals: Rights assignments, licensing agreements, pledges, and changes of corporate details (name/address) must be officially registered with MCIPO to be legally binding against third parties.
Legal Remedies & Enforcement
Cancellation & Invalidity: Non-use revocation actions and absolute/relative invalidity claims must be filed directly with the Court of First Instance (Tribunal de Première Instance) of Monaco.
Customs Enforcement: Brand owners can file border detention requests with French/Monegasque Customs under applicable bilateral customs arrangements to intercept counterfeit goods.
Country-Specific Risks & Practical Insights
No European Union Trademark (EUTM) Coverage: Because Monaco is not part of the EU, an EU Trademark (EUTM) registration does not protect brand rights in Monaco. Rights must be secured via a national filing at MCIPO or an international Madrid Protocol designation ("MC").
Absence of Opposition Window: Monaco is one of the few European jurisdictions without an administrative opposition system. Conflicting filings can only be challenged post-grant via court litigation.
Economical 3-Class Base Structure: The basic national filing fee (€130) covers up to 3 Nice classes, making multi-class applications cost-effective.
