System: National IP system. Liechtenstein is a member of the European Economic Area (EEA), but it is not a member of the European Union (EU); European Union Trademarks (EUTM) do not cover or extend to Liechtenstein. (Note: Under a bilateral treaty, protection in Liechtenstein can also be coordinated or recognized via certain Swiss administrative channels, but Liechtenstein maintains its own distinct register).
International Treaties
Madrid System: Member of both the Madrid Agreement and the Madrid Protocol (since March 17, 1998). Liechtenstein can be designated in international applications via WIPO.
Paris Convention: Member state; convention priority can be claimed within 6 months from the initial priority filing date.
Applicant & Representation Requirements
Entitlement: Both natural persons and legal entities (domestic or foreign) are eligible to apply.
Representation for Foreign Applicants: Non-resident applicants established outside Liechtenstein, Switzerland, or the European Economic Area (EEA) must be represented by a registered representative domiciled or established within Liechtenstein or the EEA/Switzerland network.
Power of Attorney (POA): Required when represented. A simple signed Power of Attorney is accepted; notarization or Legalization/Apostille is not required unless requested under specific doubts by the Office.

E-Filing: E-filing and digital submission workflows are supported via the Office of Economic Affairs services.
Free Trademark Search Database: Official publications and search functions are accessible via the Official Journal portal (Amtsblatt), as well as TMview and the WIPO Global Brand Database.
Registrable Mark Types
Types: Words, figurative signs, combined logos, 3D shapes/packaging, color marks, sound (audio/musical notation), and other signs capable of graphical or precise representation.
Foreign Characters & Translation: Applications featuring non-Latin characters or foreign terms must include a transliteration into the Latin alphabet and a translation into German upon request.
Classification Framework
Nice Classification: Applies the active edition of the Nice Classification.
Multi-class Filings: Permitted under a single application.
Base Class Inclusion: The basic national filing fee covers up to 3 classes.
Class Headings: Accepted, provided they comply with standard clarity and precision guidelines.
Examination Process
Examination Scope:
Formal & Absolute Grounds: Examined ex officio by the Office of Economic Affairs (distinctiveness, descriptiveness, genericness, public policy, deceptive signs).
Relative Grounds: The Office does not evaluate or refuse applications on relative grounds (prior conflicting rights) ex officio. Relative rights disputes rely on third-party opposition proceedings or court action.
Office Action Deadlines: Response to formal deficiency notices or provisional refusal notices is typically required within 1 to 2 months from official notification.
Publication & Opposition
Opposition Window: 3 months starting from the publication date of the trademark in the official publication channel (Amtsblatt).
Standing: Owners of earlier registered trademarks, international registrations designating Liechtenstein, pending applications with earlier priority, or well-known marks under Article 6bis of the Paris Convention.
Timeline & Expedited Examination
Average Timeframe: Approximately 3 to 6 months from filing to registration in smooth cases without office objections or third-party oppositions.
Expedited Examination: Fast-track / accelerated examination procedures are available upon request and payment of an official urgency fee.
Official Fees
Official statutory fees at the Office of Economic Affairs are assessed in Swiss Francs (CHF):
Base Filing Fee (Covers up to 3 Classes): CHF 400.
Additional Class Fee (From 4th Class onward): CHF 50 per class.
Renewal Fee (10-year term - Covers up to 3 Classes): CHF 400.
Renewal Additional Class Fee: CHF 50 per class exceeding the 3rd.
Duration & Renewal
Validity Period: 10 years calculated from the filing date.
Renewal Duration: Renewable indefinitely for consecutive 10-year terms. Renewal requests can be filed within 6 months prior to expiration.
Grace Period: A 6-month grace period post-expiration is allowed for late renewal, subject to an official late payment surcharge.
Use Requirements & Priority System
Priority System: First-to-file system.
Non-Use Cancellation: A registered trademark becomes subject to revocation on non-use grounds if it is not put to genuine commercial use in Liechtenstein for a continuous period of 5 years post-registration.
Declaration of Use: No periodic maintenance declarations or affidavits of use are required during routine 10-year renewals.
Post-Registration Transactions
Recordals: Rights assignments, licensing agreements, pledges, and changes of corporate details (name/address) must be officially registered in the Trademark Register to be enforceable against third parties.
Legal Remedies & Enforcement
Cancellation & Invalidity: Non-use revocation actions and absolute/relative invalidity claims are filed administratively or brought directly before the Liechtenstein Princely Court (Fürstliches Landgericht) in Vaduz.
Customs Enforcement: Brand owners can file applications for customs border detention (Antrag auf Hilfeleistung) with Swiss/Liechtenstein Customs authorities to intercept counterfeit goods at the border.
Country-Specific Risks & Practical Insights
No EU Coverage: Because Liechtenstein is an EEA member state but not an EU member state, European Union Trademarks (EUTM) do not extend to Liechtenstein. Direct national filings or Madrid System designations ("LI") are strictly required.
