Official Authority: State Intellectual Property Office of the Republic of Croatia / Državni zavod za intelektualno vlasništvo (SIPO / DZIV).
Official Language: Croatian.
System: National IP system. As an EU Member State, protection in Croatia can also be secured via European Union Trademarks (EUTM) registered through EUIPO.
International Treaties
Madrid System: Member of both the Madrid Agreement and the Madrid Protocol. Croatia can be designated in international applications via WIPO.
Paris Convention: Member state; convention priority can be claimed within 6 months from the initial filing date.
Applicant & Representation Requirements
Entitlement: Both natural persons and legal entities (domestic or foreign) are eligible to apply.
Representation for Foreign Applicants: Non-resident foreign natural persons or legal entities without a real commercial establishment or domicile in the European Union (EU) or European Economic Area (EEA) must be represented by an authorized local Croatian patent/representative.
Power of Attorney (POA): Required. A simple signed Power of Attorney is accepted; notarization or Legalization/Apostille is not required.
Online Services & Database
E-Filing: Electronic application filing is available directly via the DZIV online portal (e-Prijave).
Free Trademark Search Database: Publicly searchable via the official DZIV register database (e-Fond), as well as TMview, EUIPO eSearch plus, and WIPO Global Brand Database.
Registrable Mark Types
Types: Words, logos/figurative elements, 3D shapes/packaging, color combinations, sound, motion, multimedia, holograms, and other signs capable of distinguishing goods or services.
Foreign Characters & Translation: Signs featuring non-Latin scripts or non-Croatian words must include a transliteration into the Latin alphabet and a translation into Croatian.
Classification Framework
Nice Classification: Uses the active edition of the Nice Classification.
Multi-class Filings: Permitted under a single application.
Class Headings: Accepted, provided they comply with EU Common Practice standards for clarity and precision.
Examination Process
Examination Scope:
Formal & Absolute Grounds: Examined ex officio by DZIV (distinctiveness, descriptiveness, genericness, public policy, deceptive signs).
Relative Grounds: DZIV does not conduct ex officio relative grounds examination for prior conflicting rights. Protection against identical or confusingly similar prior marks relies entirely on the third-party opposition mechanism.
Office Action Deadlines: Response to formal deficiencies or provisional refusals on absolute grounds is typically required within 2 months from official notification.
Publication & Opposition
Opposition Window: 3 months starting from the date of publication of the trademark application in the official IP gazette (Hrvatski glasnik intelektualnog vlasništva).
Standing: Owners of earlier national registered trademarks, pending applications, EUTMs, international registrations designating Croatia/EU, or well-known marks under Article 6bis of the Paris Convention.
Timeline & Expedited Examination
Average Timeframe: Approximately 8 to 12 months from filing to registration in smooth cases without opposition or office actions.
Expedited Examination: Fast-track examination can be requested under specific procedural conditions and urgency fee payments.
Official Fees
Official statutory fee structures in Croatia are calculated in Euros (EUR):
Specific official state statutory fee schedules (base filing fees, additional per-class fees, maintenance certificate costs) are currently published on the DZIV official fee tariffs schedule.
Duration & Renewal
Validity Period: 10 years calculated from the filing date.
Renewal Duration: Renewable indefinitely for consecutive 10-year periods.
Grace Period: A 6-month grace period following the expiration date is granted for late renewal submissions, subject to an official late surcharge.
Use Requirements & Priority System
Priority System: First-to-file system.
Non-Use Cancellation: A registered trademark becomes subject to revocation on non-use grounds if it is not put to genuine commercial use in Croatia for a continuous period of 5 years post-registration.
Declaration of Use: No periodic maintenance declarations or affidavits of use are required during standard 10-year renewals.
Post-Registration Transactions
Recordals: Rights assignments, licensing agreements, pledges, and changes of corporate details (name/address) must be officially registered with DZIV to be effective against third parties.
Legal Remedies & Enforcement
Cancellation & Invalidity: Non-use cancellation actions and absolute/relative invalidity claims are examined administratively by DZIV or brought before competent civil courts in Croatia.
Customs Protection: Brand owners can file applications for customs detention with the Customs Administration of the Republic of Croatia under EU Customs Regulations (Regulation EU 608/2013) to prevent counterfeit goods entering or transiting the EU.
