Official Authority: Institute for Intellectual Property of Bosnia and Herzegovina / Institut za intelektualno vlasništvo Bosne i Hercegovine.
Official Languages: Bosnian, Croatian, and Serbian.
System: National IP system. Bosnia and Herzegovina is not a member of the European Union; European Union Trademarks (EUTM) do not cover this jurisdiction.
International Treaties
Madrid System: Member of both the Madrid Agreement and the Madrid Protocol. Bosnia and Herzegovina can be designated in international trademark applications via WIPO.
Paris Convention: Member state; priority can be claimed within 6 months from the initial filing date.
Applicant & Representation Requirements
Entitlement: Both natural persons and legal entities are eligible to apply.
Representation for Foreign Applicants: Foreign natural or legal persons without a domicile, residence, or real commercial establishment in Bosnia and Herzegovina must be represented by a registered local patent or representative.
Power of Attorney (POA): Required. A simple signed POA is accepted; notarization or legalization/apostille is generally not required. The POA may be submitted late upon request within a designated period set by the Institute.

E-Filing: E-filing tools and downloadable submission structures are supported via the Institute's portal.
Free Trademark Search Database: Public registers and search tools are accessible via the official Institute portal and indexed through WIPO’s Global Brand Database.
Registrable Mark Types
Types: Words, logos/figurative marks, 3D shapes, color combinations, sounds, and other distinctive signs capable of graphical representation.
Foreign Characters & Translation: Applications with marks in non-Latin scripts or foreign languages must be accompanied by a transliteration into the Latin alphabet and a translation into one of the official local languages.
Classification Framework
Nice Classification: Follows the active edition of the Nice Classification.
Multi-class Filings: Permitted under a single application.
Class Headings: Accepted, provided the designated goods or services are sufficiently specific and clear.
Examination Process
Examination Scope:
Formal & Absolute Grounds: Examined ex officio by the Institute (distinctiveness, descriptiveness, deceptive elements, public policy).
Relative Grounds: Examined ex officio by the Institute to check for prior conflicting rights, as well as open to third-party opposition.
Office Action Deadlines: Standard response time for formal deficiencies or provisional refusals is typically 2 months from official notification.
Publication & Opposition
Opposition Window: 3 months starting from the date of publication of the application in the official IP gazette (Službeni glasnik).
Standing: Owners of earlier registered trademarks, pending applications with earlier priority, or well-known marks under Article 6bis of the Paris Convention.
Timeline & Expedited Examination
Average Timeframe: Approximately 12 to 18 months from filing to registration in smooth, un-opposed cases.
Expedited Examination: Available upon written request and payment of official urgency fees under specific conditions.
Official Fees
Official statutory fees assessed by the Institute are set in Bosnian Convertible Marks (BAM / KM):
Filing Fee (Up to 3 Classes): BAM 250.
Additional Class Fee (From 4th Class): BAM 25 per class.
Registration & Maintenance Fee: Separate official maintenance and certificate issuance fees apply upon grant (e.g., BAM 100 for a 10-year period).
Duration & Renewal
Validity Period: 10 years calculated from the filing date.
Renewal Duration: Renewable indefinitely for consecutive 10-year terms.
Grace Period: A 6-month grace period is granted following the expiration date for late renewal filings, subject to an official late surcharge.
Use Requirements & Priority System
Priority System: First-to-file system.
Non-Use Cancellation: A registered trademark becomes subject to revocation on non-use grounds if it is not put to genuine commercial use in Bosnia and Herzegovina for a continuous period of 5 years post-registration.
Declaration of Use: Maintenance declarations or affidavits of use are not required during routine renewals.
Post-Registration Transactions
Recordals: Rights assignments, licensing agreements, changes of name, and changes of address must be officially registered with the Institute to be enforceable against third parties.
Legal Remedies & Enforcement
Cancellation & Invalidity: Non-use revocation actions and invalidity claims based on relative/absolute grounds are submitted administratively to the Institute or brought before the competent court in Bosnia and Herzegovina.
Customs Protection: Brand owners can file for customs recordal with the Indirect Taxation Authority (ITA) of Bosnia and Herzegovina to stop counterfeit imports at the border.
Country-Specific Risks & Practical Insights
No EU Coverage: Brands holding European Union Trademarks (EUTM) receive no protection in Bosnia and Herzegovina; direct filings or Madrid designations naming "BA" are necessary.
Multi-Class Base Inclusion: The base application filing fee covers up to 3 classes, making multi-class filing highly cost-effective up to the 3rd class.
Ex Officio Relative Examination: The Institute conducts ex officio relative grounds checks during substantive examination, giving an initial layer of defense against identical squatters prior to opposition.
